About the Organization:

The Division of Insurance ("DOI"), an Agency within the Office of Consumer Affairs and Business Regulation, administers the Commonwealth's insurance consumer protection laws through its regulation of the insurance industry. The primary mission of the Division is to monitor the solvency of its licensees in order to promote a healthy, responsive and willing marketplace for consumers who purchase insurance products. The Division also investigates and responds to consumer inquiries and complaints, enforces state insurance laws and regulations, and provides the public with accurate and unbiased insurance information. An important aspect of the Division's work is ensuring that the individuals and business entities conducting the business of insurance in Massachusetts do so in a legal and timely manner.

About the Role:

The Division's Market Conduct Section, by initiating comprehensive or limited scope examinations, reviews the operations of domestic and foreign licensed insurance companies, pharmacy benefit managers or other insurance related entities licensed or certified by the Division to ensure compliance with state laws, regulations and bulletins. Such examinations may include a review of company operations and management, complaint handling, marketing and sales, producer licensing, underwriting and rating and claims handling. Market conduct examinations are initiated consistent with internal scheduling procedures and as a result of market analysis. Specifically, the Market Conduct Section is responsible for: Conducting comprehensive and limited scope market conduct examinations; Conducting market analysis on certain lines of business; Determining whether multi-state regulatory settlement agreements negotiated by other states are fair to Massachusetts consumers; Monitoring the progress of multi-state regulatory settlement agreements in which the Massachusetts Division of Insurance was a lead state negotiator; and Participating in National Association of Insurance Commissioners market conduct and market analysis related committees, working groups and task forces.

Duties and Responsibilities:

  • At the direction of and under the supervision of the Director of Market Conduct:
    • Assist in the conduct market conduct examinations of health insurers to determine compliance with the Commonwealth's Mental Health Parity requirements pursuant to M.G.L. c. 8, §§ 8K, 8L and 8M.
    • Conduct market analysis and examinations in order to identify insurance companies that may not be in compliance with Massachusetts insurance laws, regulations, and bulletins designed to protect consumers.
    • Assist in conducting meetings and conferences with consultants, third parties, and staff to discuss the status of work in progress. Review operating and organizational issues when necessary and, where appropriate, at the direction of the Director of Market Conduct provide training and technical guidance to staff regarding areas related to market conduct.
  • Assist the Director of Market Conduct:
    • In ensuring that in conducting any market conduct examinations and analysis the Division's work is incompliance with any and all applicable standards issued by the National Association of Insurance Commissioner.
    • To allocate market conduct analysis and examination work assignments to consultants as appropriate; monitor and supervise the progress of all work assigned to third parties. Ensure that consultants perform appropriate analysis of licensed entities.
    • In ensuring that all examination-related files are maintained in accordance with Division procedures.
    • To monitor insurance industry trends, analyze their impact on consumers and the insurance marketplace, and coordinate necessary efforts within the Division to manage the identified trends.
  • If requested to do so by the Director of Market Conduct intermittently or on a regular basis meet with the Director of Market Conduct with Division Directors and Managers to establish inter-departmental communications on such topics as (1) complaint activity; (2) producer misconduct and licensing issues; (3) legal and enforcement issues; (4) financial concerns; and irregularities in rate and form fillings.
  • Participate in NAIC market conduct related working groups and sub-working groups as assigned by the Director of Market Conduct or the Deputy Commissioner and General Counsel as approved by the Commissioner of Insurance.
  • When directed to do so by the Director of Market Conduct meet with representatives of insurance companies and other licensed entities to discuss the market conduct process or the results of an analysis or examination.
  • As assigned by the Director of Market Conduct or the Deputy Commissioner and General Counsel, serve on Division selection committees assigned with evaluating bids for pre-qualified consultant pool for Market Conduct and Market Analysis Examinations.
  • At the direction of and under the supervision of the Director of Market Conduct or the Deputy Commissioner and General Counsel conduct market conduct examinations of Pharmacy Benefit Managers pursuant to M.G.L. c. 176Y.
  • Such other Market Conduct related matters as assigned by the Director of Market Conduct or the Deputy Commissioner and General Counsel.

Preferred Knowledge, Skills, and Abilities:

  • Basic knowledge of market conduct and analysis principals and procedures.
  • Knowledge of the methods of technical and general report writing.
  • Knowledge of the Commonwealth's insurance laws and regulations.
  • Ability to exercise sound judgment.

  • Ability to prepare technical and general reports.
  • Ability to work independently.
  • Ability to listen carefully and to gather information through questioning and observing individuals and by examining records and documents.

  • Ability to determine proper format and procedure for assembling items of information.

SALARY PLACEMENT IS DETERMINED BY YEARS OF EXPERIENCE AND EDUCATION DIRECTLY RELATED TO THE POSITION AND THE HUMAN RESOURCES DIVISION'S RECRUITING GUIDELINES. IN THE CASE OF A PROMOTIONAL OPPORTUNITY, THE SALARY PROVISIONS OF THE APPLICABLE COLLECTIVE BARGAINING AGREEMENT WILL APPLY TO (OR WILL BE UTILIZED FOR) PLACEMENT WITHIN THE SALARY RANGE.

Qualifications

Minimum Entrance Requirements:

Applicants must have at least (A) three years of full-time, or equivalent part-time, professional experience in accounting, auditing, or in the examination of insurance companies or in the regulation of the insurance industry, or (B) any equivalent combination of the required experience and the substitutions below.

Substitutions:

I. A Bachelor's degree with a major in accounting, business administration, business management or insurance may be substituted for a maximum of two years of the required experience.

II. A Graduate degree with a major in accounting, business administration, business management or insurance may be substituted for the required experience.


*Education toward such a degree will be prorated on the basis of the proportion of the requirements actually completed.

Special Requirements: Based on assignment, possession of a current and valid Massachusetts Motor Vehicle Operator's license may be required.
