Job Description:
The Head of USCA Legal Services and Debt Sale is responsible for the intersection of collections, legal services, and debt sales and involves a complex interplay of regulations, procedures, and potential risks. This role is accountable for measurable improved accuracy, legal consistency and overall engagement while performing difficult recovery of charged off accounts.
The Head of USCA Legal Services and Debt Sale is responsible for multiple vendor engagements and their oversight which will aid in providing the customer a consistent and accurate approach.
The Head of USCA Legal Services and Debt Sale provides feedback to the origination side of the business and be an impactful partner, ensuring the bank an efficient communication model.
Depth & Scope:
- Provides people management leadership by hiring the best talent, setting goals, developing staff, managing employee performance and compensation decisions, promoting teamwork and handling any/all disciplinary actions, as required
- Familiarity with the overall Collections and Recovery structure and model delivery
- Full understanding of the current US legal system structure involving collections, bankruptcy and selling of non-performing debt to third parties
- Understanding of all TD retail bank products, their underlying contractual structure and the ability to collect after default
- Manages multiple teams in multiple locations across the USA that vary in process delivery. These teams may be multiple and number greater than 100 FTE
- Ability to represent the bank in both a witness capacity, deponent or otherwise coaching/preparation of legal participants
- Have a clear understanding of US accounting methods regarding problem loans, credit cards and deposit products
- Have experience managing third-party vendors and the bank-level scrutiny that is ongoing including cyber risk and other technical expectations required by regulatory and local jurisdictions
- Have strong familiarity with the debt sale process, contract structure, buyer requirements and overall market assessments
- Some experience with Accounts Payable and the activities involved managing legal and overall vendors that support USCA
- Ability to handle and manage a defensive litigation caseload involving direct, counter and other litigation matters where TD is the defendant. In most cases this involves the business entity affected and TD Legal as the representative
- Frequent TD Executive engagement and communication including the ability to present complex items to individuals with limited legal knowledge
- Ability to quickly assess Recovery strategy and other activity that may require change and subsequent assessments of changes
- Frequent interaction with Data and Analytics on complex reporting items including NPV, annuity valuation and overall expense effectiveness
- Expected interaction with all regulatory agencies at both the federal and state levels given the legal activity executed in each jurisdiction. Presentation of bank performance and material may be periodically necessary
- Frequent engagement with regulators including the OCC, CFPB, FRB, FDIC and OSFI
Education & Experience:
- 10+ years of experience in the Financial Services Industry, including 5 years management experience within a collections function
- Legal expertise, experience & sound legal judgment
- Strategic thinker
- Skilled leader, high confidence, low ego, inspiring to professionals, operates through influence, motivates and develops leadership teams
- Delivers on objectives, focuses on what matters and can work across silos to build effective working relationships
- Clear, concise communicator, capable of influencing positive outcomes
- Comprehensive knowledge of principles, policies and practices related to operations is required
- Demonstrated ability to initiate and coordinate projects involving multiple functional areas of the Company
- Demonstrated ability to make sound and cost-effective business decisions in an ever changing, dynamic environment
- Superb problem solving skills and ability to quickly apply effective conflict resolution strategies
- Excellent written and verbal communication skills required with ability to successfully communicate and influence all levels of the organization a must
