Sr. Counsel, Legal - Employment

Overview

The Senior Counsel, Employment Law position is a full-time position responsible for independently providing legal counsel, strategy, and direction on a wide variety of employment law and human resources matters. The position will initially have responsibility to provide legal advice relating to (1) a broad range of employment-related issues for our delivery-focused concepts and other new restaurant ventures, including, for example, wage and hour issues, tip administration, and labor systems technology for these concepts; (2) other employment matters across various business teams; (3) proactive litigation risk management strategy between and among entities and consistent with Chick-fil-A's franchise model; and (4) policies, processes, and training for Company-operated delivery-focused and other new concepts in compliance with federal, state and local employment laws. This role will require significant experience navigating wage and hour, employment discrimination, mandated paid and unpaid leave, and other similar federal, state and local employment-related laws, as well as an understanding of franchise laws and how to support various labor systems in a franchise system. The position also will be assigned various other labor and employment law and human resources-related projects, as needed.

Responsibilities

  • Provide strategic direction and high-level counsel to delivery-focused and new ventures teams, technology solutions, payroll, and other inhouse business partners on the evaluation, selection, and implementation of various employment-related systems and processes used or made available to these concepts as tools to assist with recruiting, onboarding, timekeeping, payroll, scheduling, tip administration, and other related issues in compliance with federal, state and local employment laws and consistent with Chick-fil-A's franchise model.
  • Research, educate, and provide strategic advice to business partners on federal, state, and local employment and franchise laws applicable to various employment-related systems, delivery-focused concepts, and other new concepts.
    Partner with the business in the development of ongoing employment related strategies, processes, and initiatives for delivery-focused and other new concepts consistent with Chick-fil-A's franchise model.
  • Independently manage and lead counsel to human resources and management on employee relations, leave and accommodations, performance management, discipline, internal investigations, separations, wage and hour, federal/state/local law compliance, and other employment issues involving delivery-focused and other new concepts operated by Chick-fil-A, Inc. and its related entities.
  • Lead, develop, and present training programs on employment laws and developments for delivery-focused and other new concepts operated by Chick-fil-A, Inc. and its related entities.
  • Lead efforts to develop and update human resources documents (e.g., policies, handbooks, and other communications) for delivery-focused and other new concepts operated by Chick-fil-A, Inc. and its related entities.
  • Serve on cross-functional teams and attend business meetings to provide legal advice to business partners on a wide variety of employment law and related subjects across the organization.
  • Help manage outside counsel work and costs.
  • Assist with various administrative matters, as needed, such as leading team meetings, planning, budgeting, and strategy for the team.


Minimum Qualifications

  • Eight (8) years of experience in employment litigation and employment/human resources advice and counseling.
  • Four (4) year college degree.
  • Law degree from accredited law school.
  • State Bar membership.
  • Demonstrated academic success in law school (top 25% of class).


Preferred Qualifications

  • Subject-matter focused in-house corporate experience and/or large law firm and/or employment and labor defense boutique experience.
  • Experience leveraging labor systems to navigate and streamline compliance with federal, state, and local employment requirements.
  • Strong communication skills.
  • Strong writing and editing skills.
  • Strong analytical and reasoning skills.
  • Ability to identify and set priorities.
  • Detail oriented with strong organizational skills.
  • High level of initiative and desire to work with an in-house legal department.
  • Ability to serve leadership and supporting roles in cross-functional projects and/or on cross-functional teams.
