WORKERS' COMPENSATION LITIGATION COUNSEL

Agency Overview

The Human Resources Division is an agency within the Executive Office for Administration and Finance. HRD provides legal advice, civil service guidance, training, policy guidance, and technical assistance to state agencies and municipalities. HRD provides support in all matters relating to the Commonwealth's classification, compensation, benefits, recruitment, training & employee development, civil rights, collective bargaining and workers compensation administration.

General Statement of Duties

Defends the Commonwealth's Human Resources Division/Workers' Compensation Unit (HRD/WC) (approximately 150 state agencies) in all workers' compensation matters before the Department of Industrial Accidents (DIA).

Primary duties include:

  1. Prepares and litigate cases before the DIA at all levels including conciliation, conference, hearing and Reviewing Board.
  2. Prepares witnesses for both direct and cross examination, deposes physicians, drafts legal memorandum, motions, and briefs.
  3. Interprets laws, court decisions and opinions, rules and regulations applicable to the agency.
  4. Assesses cases, develops litigation strategies, and drafts settlement recommendations for client agencies.
  5. Communicates and coordinates with HRD/WC Claims Unit.
  6. Corresponds and negotiates with opposing counsel.
  7. Provides legal advice to state agencies and the self-insurer on all workers' compensation related matters.
  8. Travels to Regional DIA locations.

Preferred Qualifications:

Experienced workers' compensation attorney with a minimum of 3 years of experience litigating cases at the Department of Industrial Accidents. Able to work independently and as part of a team. Experience in providing legal advice on all aspects of workers' compensation law. The candidate should be able to balance multiple projects concurrently. Experience with Microsoft Office Suite, including but not limited to Word, Teams, PowerPoint and Excel. Candidate should have excellent written and oral communication skills. General knowledge of Massachusetts leave and retirement laws.

Minimum Qualifications:

Juris Doctor (JD) degree and membership in the Massachusetts Bar.

Possession of a current and valid Massachusetts Class 3 Motor Vehicle Operator's License and the ability to travel to all DIA locations including Boston, Fall River, Worcester, Lawrence and Springfield.

MINIMUM ENTRANCE REQUIREMENTS:

Applicants must have at least (A) five (5) years of full-time or, equivalent part-time, professional, administrative, supervisory, or managerial experience in business administration, business management, public administration, public management, clinical administration or clinical management of which (B) at least one (1) year must have been in a project management, supervisory or managerial capacity or (C) any equivalent combination of the required experience and substitutions below.

Substitutions:

I. A certificate in a relevant or related field may be substituted for one (1) year of the required (A) experience.

II. A Bachelor's degree in a related field may be substituted for two (2) years of the required (A) experience.

III. A Graduate degree in a related field may be substituted for three (3) years of the required (A) experience.

IV. A Doctorate degree in a related field may be substituted for four (4) years of the required (A) experience.
