Duties and Responsibilities (these duties are a general summary and not all inclusive):
• Collaborate with board members and investigators to assess consumer complaints and determine whether allegations constitute professional misconduct.
• Draft and negotiate voluntary surrender agreements and consent agreements with licensed professionals, ensuring alignment with regulatory standards.
• Conduct comprehensive legal research and analysis of applicable statutes, regulations, and case law to inform case strategy and decision-making.
• Review and evaluate investigative materials, case files, and evidentiary submissions to assess facts, identify issues, and support prosecution efforts.
• Prepare and draft orders to show cause to initiate formal adjudicatory proceedings.
• Develop and file legal pleadings, including discovery requests, motions, and memoranda of law in support of case positions.
• Formulate and execute case strategies by managing discovery, identifying key evidence and witnesses, and preparing cases for administrative hearings.
• Represent the agency in administrative hearings, advocating independently to ensure consistent application of laws and effective case resolution.
• Draft post-hearing briefs and provide recommendations regarding case outcomes, including settlement, negotiation, or further litigation.
• Advise agency staff on legal and regulatory matters by interpreting laws, rules, and judicial decisions relevant to operations and enforcement activities.
• Coordinate with external law enforcement partners, consult with the DPH Privacy and Data Access Office as needed, and manage assigned caseloads in compliance with all applicable professional, ethical, and agency standards.
Required Qualifications:
• Demonstrated knowledge of the theory, principles and practice of law.
• Knowledge of procedures followed in courtroom and administrative proceedings.
• General understanding of the methods and ability to conduct legal research and technical report writing.
• Capacity to read and interpret legal documents and apply the laws, rules, and regulations governing agency operations.
Preferred Qualifications:
• Active membership in good standing with the Massachusetts Bar.
• Demonstrated experience in administrative law, regulatory enforcement, or professional licensure discipline.
• Strong litigation and advocacy skills, with experience representing clients in hearings, trials, or quasi-judicial proceedings.
• Experience drafting complex legal documents, including pleadings, motions, briefs, and settlement agreements.
• Knowledge of healthcare laws, regulations, and professional licensing frameworks is strongly preferred.
• Proven ability to analyze complex legal issues, evaluate evidence, and develop effective case strategies.
• Experience working with or advising government agencies, boards, or commissions.
• Strong interpersonal and communication skills, with the ability to collaborate effectively with investigators, board members, and external stakeholders.
• Ability to manage a high-volume caseload, prioritize competing demands, and meet deadlines in a fast-paced environment.
• High level of professionalism, sound judgment, and commitment to public service, ethics, and confidentiality.
• Proficiency with Microsoft Office Suite, particularly Word, Excel, Outlook, and Teams.

Qualifications

MINIMUM ENTRANCE REQUIREMENTS: Applicants must have a Juris Doctor (JD) degree, admission to the Massachusetts Bar and (A) at least three years of full-time, or equivalent part-time, professional experience in the practice of law.
Incumbents may be required to have a current and valid Motor Vehicle Drivers License at a Class level specific to assignment.
Salary placement is determined by a combination of factors, including the candidate's years of directly related experience and education, and alignment with our internal compensation structure as set forth by the Human Resources Division's Hiring Guidelines. For all bargaining unit positions (non-management), compensation is subject to the salary provisions outlined in the applicable collective bargaining agreement and will apply to placement within the appropriate salary range.
