Director of Testing Compliance
Job Description
I. PURPOSE OF THE JOB
The Director of Testing Compliance, under the direction of the Chief of Investigations and Enforcement (CIE), is responsible for the oversight and management of the Testing team to ensure effective monitoring of Independent Testing Laboratories (ITLs) to ensure regulatory compliance and quality standards. This position is responsible for collaborating with other teams within the Investigations and Enforcement Department (the "Department"), ensuring that licensed Marijuana Establishments (ME) and Medical Marijuana Treatment Centers (MTCs) throughout the Commonwealth are adhering to/complying with the Cannabis Control Commission's regulations and established protocols in a consistent manner with the objective to further the Commission's mission of ensuring access to compliantly tested Marijuana and Marijuana Products.
The Director of Testing Compliance manages the Testing staff within the department and leads the Commission's efforts to monitor, evaluate, and analyze industry practices and trends impacting Marijuana testing, cultivation, and product manufacturing. The Director of Testing Compliance is responsible for identifying trends to develop, modernize, and implement testing regulations, policies and protocols, as well as a periodic, systematic review of such regulations, policies and protocols to ensure continued effectiveness and testing consistency.
II. ESSENTIAL FUNCTIONS AND RESPONSIBILITIES
• Manages and mentors the Testing team, to support the Department's responsibilities and demands;
• Conducts on-site inspections at ITLs to evaluate operational capacity, standard operating procedures, observe and assess testing methodologies, and inspect the licensed premises to determine compliance with Commission laws, as well as other applicable state and federal regulations for overall safety, accuracy, and reliability of testing results;
• Collaborates with other key Department staff to review, develop, and propose modifications to policies and procedures for the efficient licensure, inspection, and investigation of ITLs;
• Supervises and participates in the collection and auditing of data from the Commission's seed-to-sale tracking system (Metrc) to identify testing parameters and related results;
• In collaboration with other key Department staff, monitors and tracks the status of ITL licenses, certifications, and other requirements, such as accreditation to ISO 17025:2017;
• Leads efforts to implement state-of-the-art techniques and approaches for collecting and analyzing testing and research related data;
• Must understand testing laboratory operations and standardized inspection processes;
• Assists Department staff in developing enforcement approaches for testing protocols and procedures to ensure that MEs and MTCs are demonstrating compliance with state and federal Marijuana laws and regulations;
• Ensures strict adherence to safety protocols and regulatory standards;
• Utilizes research and industry trend analysis to evaluate, revise, and implement new or additional regulations, protocols, and methodologies regarding marijuana testing, including, but not limited to, testing for cannabinoids (potency), pesticides, residual solvents, heavy metals, microbials, terpenes, water content, and Vitamin E Acetate for vaporizer products.
III. OTHER DUTIES AND RESPONSIBILITIES

• Maintains the highest standards of personal, professional, and ethical conduct and supports the Commission's goals for a diverse and culturally aware workforce;
• Collaborates with other state agencies, including, but not limited to, the Department of Agricultural Resources and the Department of Public Health to develop effective inspection procedures;
• Stay current with emerging trends, applications, systems and processes to establish best practices for Marijuana testing;
• Present information, such as policy recommendations and investigatory findings, to Commission leadership and at public meetings, as required; and,
• Performs other related duties as assigned.
IV. SUPERVISORY RESPONSIBILITIES
• The Director of Testing Compliance will oversee the work of the Testing team.
Qualifications
V. KNOWLEDGE AND SKILLS
• Ability to effectively lead a team in a complex regulatory environment;
• Excellent quantitative statistical knowledge and analysis skills;
• Advanced experience with at least one high-level statistical software program (R, SAS, Stata, SPSS, etc.);
• Experience with SQL;
• Must demonstrate sound judgement and decision-making abilities;
• Must communicate effectively and manage communication flow internally among teams and externally with ITLs;
• Strong analytical ability, and demonstrated skill in giving clear and concise directions, excellent verbal and writing skills;
• Ability to express thoughts clearly and to develop and communicate ideas in logical sequence;
• Adept at presenting information in an accurate and concise format;
• Ability to think critically and strategically;
• Comfortable working well with teams, and as a leader and member.
• Ability to seek opportunities to resolve problems, achieve goals, or otherwise advance the Commission's mission;
• Ability to operate a motor vehicle and possesses a valid Driver's License from Massachusetts or another state;
• Ability to work in and travel to the Commissions headquarters in Worcester, along with other locations across the state as required; and
• Approximately 25 to 50% of the time is spent in the field, out of the office.
VI. EDUCATION AND EXPERIENCE
• Bachelor's degree in Chemistry , Microbiology, Biology or related field from an accredited institution of higher education preferred;
• Minimum of 5-7 years of direct or related experience in Chemistry, Microbiology, Toxicology, and Biology;
• Minimum of 3-5 years experience in the cannabis regulatory industry preferred; and
• Solid background in public policy, regulatory analysis, inspectional and investigatory skills, and/or regulatory enforcement/compliance and demonstrable experience in the laboratory field;
• Demonstrated experience managing teams, projects, budget and developing quality assurance and quality control programs; and
• Strong experience using Microsoft Office, and case management systems.
