Job Description

The Drug Control Program (DCP), situated within the Department's Bureau of Health Professions Licensure, is tasked promoting prescription drug security and safe prescribing, dispensing and administration practices, and the certification of non-licensed health care professionals. DCP consists of the Massachusetts Controlled Substance Registration Program, the Prescription Monitoring Program (PMP), the Pharmaceutical and Device Manufacturer Code of Conduct (PCOC), the Drug Stewardship Program, the Medication Administration Program (MAP), the Drug Formulary Commission, and the DCP Enforcement Unit. In addition, DCP now includes two important and related programs, the Nurse Aide Registry (NAR) and the Certified Medication Aide (CMA) programs.

The Compliance Officer will review complaints, reports, documents, and pertinent information received from the public and agency personnel concerning alleged violations of laws and regulations by Certified Nurse Aides and Certified Medication Aides. The CO will conduct investigations in connection with complaints and alleged noncompliance with laws and regulations, write investigative reports, work closely with program staff and DPH litigators to determine the appropriate course of action, and testify at hearings.

Duties and Responsibilities (these duties are a general summary and not all inclusive):

  • Reviews complaints, reports, documents, and pertinent information received from the public and agency personnel concerning alleged violations of laws and regulations to determine the appropriateness of the complaint.
  • Conduct investigations, including gathering records, conducting interviews, and obtaining evidence through on-site visits to establish facts concerning complaints and alleged non-compliance with laws and regulations.
  • Write detailed investigative reports.
  • Determine appropriate action to be taken and/or to refer complaint to the appropriate agency.
  • Testify at administrative hearings as needed.
  • Maintains liaison with assigned agency personnel and various private, local, state and federal agencies and others to provide information concerning, and encourage compliance with the provisions of laws, rules, and regulations to exchange information and/or to resolve problems.
  • Responds to inquiries to provide information concerning agency policies and procedures and laws, rules and regulations governing agency activities.
  • Confers with parties to complaints to resolve issues, make appropriate settlements and encourage compliance with established laws, rules and regulations.

Required Qualifications:

  • Experience or familiarity with administrative law and procedure
  • Knowledge of the methods of general report writing
  • Ability to write concisely to express thoughts clearly and to develop ideas in logical sequence
  • Ability to gather information through questioning or observing individuals
  • Capacity to analyze and determine the applicability of data, to draw conclusions and make appropriate recommendations.
  • Ability to read and interpret legal documents such as court decisions, briefs, opinions, contracts, etc.
  • Ability to exercise discretion in handling confidential information
  • Ability to establish rapport with people from different ethnic, cultural and/or economic backgrounds
  • Capacity to communicate effectively in oral expression
  • Ability to adapt to varied work situations
  • Ability to work independently
  • Ability to interpret information contained in documents such as medical records, schedules, charts, plans, specifications, etc.

Qualifications

Minimum Entrance Requirements: Applicants must have at least (A) four years of full-time, or equivalent part-time, experience in investigatory or law enforcement work, or regulatory administration work (B) and equivalent combination of the required experience and the substitutions below.

Substitutions:

A Bachelor's or higher degree may be substituted for a maximum of the two years of the required experience.

Education toward such a degree will be prorated on the basis of the proportion of the requirements actually completed.

Salary placement is determined by a combination of factors, including the candidate's years of directly related experience and education, and alignment with our internal compensation structure as set forth by the Human Resources Division's Hiring Guidelines. For all bargaining unit positions (non-management), compensation is subject to the salary provisions outlined in the applicable collective bargaining agreement and will apply to placement within the appropriate salary range.
