What You'll Do (Responsibilities):

You will be responsible for managing and coordinating activities related to the defense of both commercial litigation (class and individual actions) and product liability matters for GM in South America. You will develop and implement strategy and tactical approaches to pending litigation. You will also ensure proper case and document management from a systems and resourcing perspective, including handling of U.S. federal reporting requirements (TREAD data) and litigation hold information. You will assign outside counsel based on the nature of claims/defenses, geographic location, fee arrangement, and GM policies.

You will work with outside counsel on the development of legal strategies and execution, collaborate with GM claims administrators, discovery teams, and engineering resources on evaluating claims and identifying any engineering safety issues, and coordinate litigation matters across South America and with GM headquarters in the U.S. Timely review of case evaluations, briefs, and motions submitted by outside counsel is essential. You will determine settlement value and trial recommendations for specific cases within established processes and coordinate the selection of litigation consultants, expert witnesses, and trial counsel. Additionally, you will partner with relevant outside counsel regarding trial preparation and provide advice and counsel to the relevant GM legal teams and business groups as needed.

Expertise:

  • Advanced knowledge and broad experience in commercial litigation and product liability.
  • Experience on managing a case portfolio with more than 5,000 cases.
  • Experience handling large dockets of smaller consumer cases efficiently and implementing strategic approaches to large, complex cases.
  • Ability to identify and leverage experts in different specialized fields.
  • Resource for technical expertise, guiding direct reports on complex problems and developing innovative solutions.
  • Drives change and develops new policies and processes in support of functional and company strategies.
  • Exercises independent judgment and influence on key technical decisions.
  • Handles litigation matters and related financial reporting obligations consistent with applicable local country and U.S. law.
  • Identification of root causes for litigation and driving change through business leaders to mitigate future risk.
  • Providing legal support for business units that are responsible for safety and emissions regulatory compliance for the business.

  • Translates strategies into clear direction for the team, reprioritizing resources based on changing business needs.
  • Enforces company policies impacting subordinate employees and resolves conflicts within the organization.
  • Develops plans for people resources, ensuring team members grow their skills and competencies.
  • Engages with supervisors, customers, and professionals to address issues across multiple sections.
  • Adapts communication style and uses persuasion and negotiation to convince others to accept new ideas.

Scope and Impact:

  • Drives strategy and implementation of large projects impacting multiple departments.
  • Accountable for workforce planning, operational, and financial decisions.
  • Sets objectives and owns the delivery of metrics and Key Performance Indicators aligned with GM strategic priorities.
  • Champions change management and influences others to accept new concepts and practices.
  • Builds a team with an optimal mix of talent and experience, supporting individual development and driving performance.

Your Skills & Abilities (Required Qualifications):

  • Degree completed in Law
  • Active OAB
  • Strong experience in commercial litigation and product liability. (Regulatory experience is a plus).
  • Strong understanding of legal strategies, case management, and litigation processes.
  • Experience on tech tools, data analytics and AI use.
  • Excellent communication, negotiation, and interpersonal skills.
  • Advanced or Fluent in English is mandatory. (Spanish is a plus).
  • Proven leadership experience with the ability to manage and develop a diverse team.
  • Strong analytical and problem-solving skills.
  • Ability to work collaboratively with various stakeholders, including outside counsel and internal teams.
  • Inclination to persistently challenge the status quo, Innovation mentality and a relentless desire to identify technology tools to enhance effectiveness and efficiency are a must
  • A desire to look outside for best practices in the market. Identify opportunities and transform them into internal business cases
  • A winning mentality. Always look on why yes and how to make it possible
  • A desire to pursue opportunities to create long term value for the Legal Staff and for GMSA, mitigating cost and driving revenue
