Job Description

The Office of the General Counsel within the Executive Office of Health and Human Services (EOHHS) seeks a dynamic individual to serve as Assistant General Counsel, MassHealth Litigation. The EOHHS General Counsel's Office is directly responsible for legal support for the MassHealth program, those core functions that are centrally managed at the secretariat level and coordinating and managing legal issues throughout the Secretariat through the General Counsels of the EOHHS constituent agencies. The legal issues related to MassHealth and other EOHHS activities are complex, requiring knowledge of many applicable federal and state laws. In addition, EOHHS attorneys provide advice on the full array of legal issues faced by any large organization, including, but by no means limited to, public procurement and contracting, litigation, trusts and estates, privacy and security, and information technology (IT).

The General Counsel's Office functions as EOHHS in-house counsel. The attorney will perform a wide range of complex legal activities generally described below:

Duties and Responsibilities (these duties are a general summary and not all-inclusive):

  • Represent MassHealth in state and federal court and before administrative bodies, including the MassHealth Board of Hearings and the Division of Administrative Law Appeals.
  • Defend MassHealth agency actions regarding eligibility and medical necessity determinations in state and federal courts.
  • Partner with the Attorney General's Office (AGO) whenever they provide representation.
  • Support MassHealth's relationship with the Medicaid Fraud Division of the AGO.
  • Support MassHealth's estate recovery and casualty recovery programs, including litigation in probate and superior court (and appellate courts when necessary)
  • Litigate MassHealth overpayment and audit recovery cases before the Board of Hearings and on appeal to superior court.
  • Provide internal legal advice, drafting and review of EOHHS regulations, policies, procedures, and other initiatives.
  • Other duties as assigned.

Required Qualifications:

  • Knowledge of theory, principles and practices of law including methods and ability to conduct legal research and technical report writing.
  • Understanding and knowledge of procedures followed in courtroom and administrative proceedings.
  • Ability to read and interpret legal documents and apply the law, rules and regulations governing agency operations.
  • Communicate effectively both verbally and in writing, to clearly and concisely express thoughts and develop ideas in a logical manner as well as exercise discretion and sound judgment.
  • Strong interpersonal and communication skills, the ability to effectively manage multiple projects simultaneously and effectively with diverse groups of people.
  • Experience and ability to use a computer to conduct research, manage databases, and produce written documents.

Preferred Qualifications:

  • Professional experience in the practice of law or in a position requiring membership in the Bar
  • Excellent academic background
  • Significant experience in counseling clients, legal research and analysis, oral and written advocacy, and creative problem-solving.
  • Strong interpersonal skills and the desire to work in a collaborative legal office.
  • Prior experience working with state and federal government, health and administrative law, health care issues and public policy.

Qualifications

MINIMUM ENTRANCE REQUIREMENTS: Applicants must have a Juris Doctor (JD) degree, admission to the Massachusetts Bar and (A) at least three years of full-time, or equivalent part-time, professional experience in the practice of law.

Incumbents may be required to have a current and valid Motor Vehicle Drivers License at a Class level specific to assignment.
