Assistant General Counsel, Consumer Regulation

Founded in 2010, Mosaic is a rapidly growing provider of consumer lending solutions for the home energy market. Currently the largest residential solar lender by volume nationally, Mosaic is expanding into new verticals in 2016, including home improvement lending.  Centrally located in beautiful downtown Oakland, we are looking for top talent to take us to the next level!

To accommodate our growth, we are actively sourcing for a passionate and experienced Assistant General Counsel, Consumer Regulation to join a small and rapidly growing legal team.  In this exciting role, you will:

  • Develop a strong and innovative compliance and risk management culture
  • Serve as a legal advisor on business matters related to sales, marketing and analysis, contract originations and consumer lending issues including consumer protection regulations, product development, and fair lending issues, among others
  • Advise Mosaic on new products, services, fees, compliance with consumer regulations, state and federal laws and regulations including but not limited to UDAAP, Reg. B, Reg. Z and relations with the CFPB
  • Collaborate regularly with stakeholders, executive staff, vendors and staff
  • Report to the General Counsel who is responsible for legal and compliance at Mosaic

Key Responsibilities

  • Serve as legal subject matter expert and counselor, providing advice to Board, Executives and staff on all consumer regulatory issues
  • Establish, maintain and leverage relationships cross-functionally with Marketing, Loan Products and Loan Servicing business units to direct activities and promote an effective and compliant consumer lending
  • Establish, implement and supervise compliance policies and procedures throughout organization to ensure compliance program is effective and efficient in identifying, preventing, and correcting non-compliance with regulatory requirements
  • Advise on compliance laws and regulations applicable to consumer lending, and day-to-day corporate operations, including consulting on the design and implementation of key strategic initiatives and business changes for the purpose of providing tactical regulatory/compliance advice on regulatory requirements
  • Ensure that remediation efforts are sufficient and timely; review action plans and remediation documentation to support event closure; participate in root cause analysis and the identification of customer experience improvement activities
  • Assist with new loan product design; provide regulatory support for existing products
  • Prepare for and coordinate third-party examinations to ensure information requests from third-party partners and regulators are completed accurately and on time
  • Strive to simplify legal, regulatory, and risk management requirements
  • Participate in business management, risk, new product and project meetings and provide compliance risk advice as well as ongoing information about new and changing regulatory developments
  • Ensure timely identification, mitigation, resolution and reporting/escalation of existing and emerging legal issues and risks
  • Serve as a member of the Compliance Committee and assist in the creation and execution of the agenda
  • Manage bankruptcies, litigation inquiries, and regulations relating to consumer lending
  • Experience with UDAAP, Regulation B and Regulation Z

Key Skills

  • Juris Doctorate (J.D.) and membership in good standing of a state bar
  • 7+ years legal experience, preferably in regulatory compliance and litigation
  • Experience with in-house legal department, private firm or government attorney role working with consumer regulatory matters
  • Must have outstanding communication skills, an ability to anticipate and deliver on the needs of a fast-paced and innovative business, and the flexibility to simultaneously manage a wide range of projects
