RESPONSIBILITIES

SUMMARY

Successful candidate will provide strategic legal counsel and privacy advise in support of E
TRADE's enterprise-wide privacy program, covering brokerage, banking, stock plan administration and financial services operations.

RESPONSIBILITIES

Serve as privacy and data protection legal "subject matter expert."
Review, draft and update as needed ETRADE's policies and procedures, customer agreements and privacy policies to ensure ongoing compliance with applicable US and international laws, rules and regulations, company practices and standards, and best practices in a changing privacy regulatory environment.
Provide privacy-related legal advice regarding social media activities and the development and implementation of mobile applications.
Support the Security Incident Response Team in connection with privacy incidents and compliance with applicable breach notification laws.
Monitor legislative and regulatory developments in the areas of privacy and data protection.
Advise on TCPA, CAN-SPAM and other laws relevant to digital advertising and marketing campaigns
Work cross-functionally to resolve individual privacy compliance issues/questions and investigations assessing causes, directing the development of corrective action plans, and ensuring consistent application of corrective actions.
Draft and negotiate marketing, technology and other business agreements for a wide range of regulated and non-regulated entities.
Interface directly with various internal business units, including marketing, finance, technology, brokerage legal, bank legal and procurement groups, as well as legal counsel and contracting personnel for counter-parties.

REQUIREMENTS

Requirements:

Minimum six (6) years of relevant privacy, data security, and digital advertising/marketing experience in a national law firm and/or in-house legal environment (in-house experience strongly preferred)
JD from top law school (Business experience a plus)

Desired Skills:

Strong knowledge of international, federal and state privacy and marketing laws, rules and regulations, state security breach and data protection laws, as well as industry leading-practices and standards.
Practical experience in counseling financial services clients and dealing with business-level implications related to financial privacy and data protection laws and regulations including initial and annual notices, opt-out processes, breach notifications, vendor / business partner due diligence and oversight
Experience negotiating and drafting complex commercial agreements
Strong and effective communications and client relationship/management skills
Ability to resolve novel, complex issues with a resourceful, "can-do" attitude.
Ability to handle multiple tasks and prioritize diverse workload
Highly developed written and oral communication skills, with special emphasis on excellent drafting and negotiation skills and attention to detail
Ability to work independently with little supervision as well as work part of a team
Advanced computer skills, including experience with Microsoft Office software, Adobe and document management systems
