About the role:

Capital One's Legal Department is looking for a talented and dynamic trademark attorney to join its fast-growing Intellectual property team in securing protection for some of the most valuable brands in financial services, including CAPITAL ONE, WHAT'S IN YOUR WALLET?, VENTURE, and QUICKSILVER. We are looking for someone who:

-is an outstanding trademark attorney with experience in clearing proposed marks for use and registration, and preparing and prosecuting trademark applications before the USPTO; the successful candidate will be responsible for protecting Capital One's brands and helping shape Capital One's enterprise-wide trademark strategy.

-can proactively engage various teams across the enterprise to identify and protect potential new brands, and provide education and training help the business maintain and protect these brands.

-can independently counsel clients and provide practical legal advice on a wide range of trademark issues, including advising on trademark clearance and prosecution matters, licensing, and acquisition.

-is an excellent verbal and written communicator; the successful candidate must feel comfortable presenting in front of colleagues and stakeholders at every level, and will need to be able to communicate complex legal concepts in a clear and simple way that fosters trust and respect.

-can demonstrate sound judgment even in novel situations, and can understand business goals in a way that helps them evaluate risk effectively and provide practical legal advice.

-has excellent organizational skills, attention to detail, and the ability to prioritize effectively to meet deadlines or business goals.

-is creative and not afraid to try something new to raise the bar and improve experiences with teammates and stakeholders; the successful candidate takes pride in their work and wants to add value outside of the day-to-day expectations of the role.

-is decisive, even in the face of ambiguity.

-can create friendly and collaborative working relationships, particularly with their teammates, the rest of the legal department, internal clients, and outside counsel. A good sense of humor and an interest in having fun at work are pluses!

Basic Qualifications:

-At least 5 years of experience drafting and prosecuting trademark applications and trademark litigation.

-Juris Doctor and membership in good standing in at least one state bar.

Preferred Qualifications:

-Experience with providing intellectual property transactional counseling, including experience with licensing agreements and M&A due diligence.

-Experience in the financial services industry, even as outside counsel to banks and others in the industry.

-Experience with social media reviews, such as reviewing proposed social media posts for potential trademark and copyright infringement issues.

-Experience with copyright issues, such as the Digital Millenium Copyright Act ("DMCA").

-Experience with right of publicity issues under state law.
