Job Description

Represents insureds and the Company in the defense of bodily injury and property damage lawsuits, subrogation, and Allstate Financial cases. Prepares for and conducts hearings, trials, arbitrations, mediations, and depositions. Prepares and argues pre and post-trial motions. Assists colleagues in the resolution of calendar conflicts. , Provides counsel to business clients on day to day issues. Monitors and reviews new laws, regulations, and case law; identifies and summarizes relevant issues; collaborates with other areas of L&R department; proactively provides advice and counsel to business unit on the impact of new laws on business; monitors counsel

As Trial Attorney, you will bring your subject matter expertise in claims defense litigation to represent clients who are customers of Allstate Insurance Company, Encompass Insurance Company, and Esurance ("the Company") in: bodily injury (BI), property damage, no-fault/PIP, special investigations (SIU), arbitration and subrogation cases. You will acquire broad knowledge of the Company and our business lines as well as assert processes, procedures and best practices. You will manage a caseload from end to end by acquiring, compiling and integrating case-related information and legal research, developing and implementing litigation strategies in cooperation with your clients and claims personnel. You will determine litigation tactics and negotiate cases for timely claims resolution.

Assess liability and damages, and develop defenses to allegations for successful resolution of cases

Attend hearings, mediations, and conduct trials

Argue motions, take effective depositions of lay and expert witnesses

Consult with clients and opposing counsel and the judiciary

Coordinate the case handling with claims personnel

Complete necessary system documentation

Assist other attorneys in resolving calendar conflicts

The Remote Attorney will be expected to handle a full pending of cases comparable to the file load of an office based attorney.

The Remote Attorney will be affiliated with an Allstate Staff Counsel office but the Remote Attorney will not have a physical office in the staff counsel location.

The Remote Attorney's equipment will be set up in the home of the Remote Attorney.

The Remote Attorney will be provided with the necessary equipment and supplies to handle cases remotely.

Remote attorneys and other workers will have regular work schedules agreed upon with their managers and must be accessible during those hours.

Home based workers and Remote Attorneys may be required to attend on-site events in an Allstate office that are necessary for the completion of their job responsibilities, including but not limited to, training, meetings, conferences, performance management conversations, etc.

The Remote Attorney will be available during regular office hours to participate in meetings, cover court appearances or travel to the Staff Counsel Office as required.

The Remote Attorney will devote 100% of their time during office hours to their Allstate responsibilities. Arrangements must be made for any obligations (e.g. child care) that would potentially interfere with this responsibility.

The performance standards for the Remote Attorneys and home based employees will be consistent with the performance standards for an office based attorney.

  • This position will serve Hamilton County (Chattanooga) Tennessee and surrounding area. (Bledsoe, Bradley, Franklin, Grundy, Hamilton, Lincoln, Marion, McMinn, Meigs, Monroe, Polk, Rhea, Sequatchie)

Job Qualifications

o 2 to 5 years litigation experience required.

o Personal injury, auto negligence, insurance defense experience preferred

o Qualified candidates will have a Juris Doctorate Degree and MUST be a member of the State Bar of Tennessee and be in good standing

o Basic computer skills are required; experience with Microsoft Office, Outlook, Computer Calendars, Westlaw, Lexis, and the internet

o Ability to work well with others on a team of attorneys, paralegals, administrative assistants, supervised by an attorney Lead Counsel

o Reliable vehicle for transportation and a valid drivers' license are required
